TERMS OF SERVICE

Plain terms for a paid tool.

What you buy: a one-time platform fee that activates one project workspace with the plan's supply ceiling, base-candidate sets and rendering tools.

What you don't buy: permanent storage, Solana network fees, marketplace listing, a promise of sales, or a right to any specific AI output.

Your keys stay yours: we never receive or hold your private key; launching to Solana runs from your bundle on your machine and is signed by the wallet you control.

Refunds: on-chain USDC payments are irreversible; we refund in specific cases listed below.

1. Who we are and what this covers

GenFT ("GenFT", "we", "us") operates the software service at sol.genft.fun (the "Service"). These terms are a contract between you and the operator of GenFT and apply to every use of the Service, including free browsing, wallet sign-in and paid plans. If you use the Service on behalf of a company or project, you confirm you may bind it to these terms.

2. Accounts and wallet sign-in

You sign in by signing a readable message with a Solana wallet. The signature proves control of the wallet; it never transfers assets and never reveals your private key. You are responsible for the wallet you use, and anyone who controls it controls your GenFT projects. We cannot recover projects attached to a wallet you lose.

4. What the platform fee does not include

Permanent decentralized storage (Arweave/Irys or similar), RPC service, Solana rent, transaction and priority fees, Metaplex protocol fees, marketplace listing or approval, taxes, and any third-party creative, legal or compliance review. These are paid by you, directly, to the relevant provider or network. Any cost figures we display are estimates and not quotes.

5. Refund policy

USDC transfers on Solana cannot be reversed by us or by anyone else. We therefore handle refunds as new transfers, and only in these cases:

We do not refund because you dislike AI candidates (you approve every candidate before it becomes a base), because your collection did not sell, because third-party costs changed, or because a wallet you do not control received the payment. Third-party costs you paid on-chain are never refundable by GenFT.

6. Your content and rights attestation

You keep all rights in the mascot art, trait layers, names and descriptions you upload. By uploading, you confirm that you own or are licensed to use them for this purpose, that they do not infringe anyone's rights, and that they are not unlawful, hateful, sexual content involving minors, or designed to impersonate a real person or brand. You grant us only the licence needed to process, store and display them back to your signed-in wallet and to operate the Service. We may remove content and suspend projects that break this section without refund.

7. AI-generated candidates

Base candidates are produced by a third-party image model conditioned on your reference. Outputs are stochastic: identity, style and quality vary, and a set may fail. You must review every candidate and you alone decide which one becomes the locked base. We do not promise that any output is unique, non-infringing, registrable or commercially usable, and we recommend independent legal review before a public sale. Rights in AI outputs are governed by the provider's terms and applicable law; we claim no ownership of them.

8. Deterministic generation, provenance and launch

Collection rendering, rarity and provenance are computed deterministically from your configuration and assets. Your private download bundle contains the configuration, every asset, and SHA-256 hashes plus a provenance root, so you (and anyone you share the bundle or the hashes with) can regenerate and verify the collection byte-for-byte. Launching on Solana is non-custodial and, in this early-access version, runs from the bundle with the documented command-line workflow on your own machine: every transaction is signed by a wallet you control, and we never receive collection or Candy Machine authority. You are responsible for the collection you publish, its metadata, royalties and any promises you make to buyers.

9. Data retention and deletion

Rendered images and metadata are kept for the plan's temporary retention period after a full render, then deleted; small reports (manifest, rarity, provenance) are kept longer so hashes remain verifiable. Download your bundle before expiry. Details are in the Privacy & data retention notice.

10. Acceptable use

Do not attempt to bypass entitlements or rate limits, access other wallets' projects, upload malware or crafted files, resell access, or use the Service to produce deceptive or unlawful collections. We may suspend or terminate access for abuse.

11. Availability, changes and support

The Service is early-access software provided "as is" and "as available". We work to keep it up and to fix defects promptly, but we do not guarantee uninterrupted availability, particular provider capacity, or that a launch will happen by a specific date. We may change or discontinue features; entitlements already paid remain deliverable through the web studio or the documented command-line workflow. Support: [email protected].

12. Liability

To the fullest extent permitted by law, GenFT is not liable for indirect or consequential loss, lost profits or sales, lost tokens caused by wallet compromise, third-party provider or network failures, or the value of any collection. Our total liability for any claim relating to the Service is limited to the platform fee you paid for the affected project. Nothing here excludes liability that cannot be excluded by law.

13. General

These terms are governed by the laws of the operator's country of establishment, and disputes will first be raised with support and handled in good faith before any formal step. If a clause is unenforceable the rest stays in force. We may update these terms; the version and effective date at the top change when we do, and continued use after a change is acceptance for future purchases.
